Professor Richard E. Levy will discuss issues surrounding independence in adjudication under the Kansas Administrative Procedure Act (KAPA) and the Kansas Judicial Review Act (KJRA), which have been the focus of significant legislative attention over the last two years. He will discuss amendments to KAPA adopted last year, the study of additional issues by the Interim Committee on the Judiciary, and the legislative history of HB 2518, which was considered by the House and Senate this spring. Issues addressed will include the authority of agency heads to conduct hearings, agency review of decisions by hearing officers in the Office of Administrative Hearings, separation of functions and limits on ex parte communication, and the scope of judicial review when agencies reverse hearing officer findings.
