Professor Peck will discuss errors and miscues in legal descriptions in real estate documents. He will begin with a short review of land description methods. He will summarize cases involving errors that have adversely affected sellers, buyers, and other parties, as well as surveyors and lawyers. Finally, he will discuss the duty of care of the lawyer working with legal descriptions and the potential for malpractice suits against lawyers.
In the wake of the Federal Rules Amendments and developing case law, e-discovery continues to transform both litigation and information management. This session will explore recent e-developments and their practical impact on how litigators practice law and clients manage data.
This session will key in on important criminal law and procedure decisions issued by the Kansas Appellate Courts, the United States Supreme Court and the Tenth Circuit Court of Appeals and will focus on how these decisions might affect the criminal law practice in Kansas.
This presentation will summarize recent significant judicial decisions and pending litigation concerning climate change. It will cover litigation in the federal courts concerning the authority of agencies such as the Environmental Protection Agency to regulate emissions of greenhouse gases, such as carbon dioxide, and the extent to which federal law preempts state regulation of those emissions. The presentation also will cover state common law and regulatory decisions, including the pending challenge to the Kansas Department of Health and the Environment’s denial of air pollution permits for two coal-fired electric generation units in Holcomb, Kan.
Keith Meyer’s presentation will cover current issues dealing with what financing transactions are covered by Article 9, how a creditor becomes a secured creditor, unique perfection issues including vehicles subject to the Kansas certificate of title statue, priority issues between various creditors and buyers of property subject to a security interest.
This program will discuss the various ethical pitfalls awaiting lawyers who use the Internet in their practice. We will discuss Web pages, Internet advertising, FAQs, and other current topics.
